1  Introduction

In using this website, you are deemed to have read, understood, and agreed to the following terms and conditions: Xtra Travel Services Ltd, trading as VisaCuba.com and hereinafter referred to as VisaCuba, is a registered company in England and Wales (Company Number: 14039089), registered at 8th Floor, Becket House, 36 Old Jewry, London, EC2R 8DD.

The following terminology applies to these Terms of Use, Privacy Statement, and Disclaimer Notice and any or all Agreements: “Client”, “You”, and “Your” refer to you, the person accessing this website and accepting the Cuba Visa terms and conditions. “The Company”, “Ourselves”, “We”, and “Us” refer to VisaCuba. “Party”, “Parties”, or “Us” refers to both the Client and ourselves, or either the Client or ourselves. All terms applicable to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client most appropriately, whether by online purchase or any other means, for the express purpose of meeting the Client’s needs in respect of the provision of the Company’s stated services/products, under and subject to prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalization, and they or they are taken as interchangeable and, therefore, refer to the same.

2  Privacy Statement

We are committed to protecting your privacy. Authorised employees within the company, on a need-to-know basis, only use any information collected from individual customers. We do not store any payment information; our merchant account does this for us for your safety. We regularly review our systems and data to ensure the best possible service to our customers. Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such activities to prosecute and take civil proceedings to recover damages against those responsible. Also, please take a look at our privacy policy notice.

3  Confidentiality

We are registered under the Data Protection Act 2018; any information concerning the Client and their respective Client Records may be passed to third parties. However, Client records are confidential and, therefore, will not be divulged to any third party other than the Cuban authorities if required by law. Clients have the right to request sight of and copies of any Client Records we keep on the proviso that we get reasonable notice of such a request. Clients must retain copies of any literature about the provision of our services. We’d like to issue clients appropriate written information, handouts, or copies of records as part of an agreed contract for the benefit of both parties. We will not sell, share, or rent your personal information to any third party.

4  Exclusions and Limitations

The information on this website is provided on an “as is” basis. To the fullest extent permitted by law, VisaCuba: a) excludes all representations and warranties relating to this website and its contents or which are or may be provided by any affiliates or any other third party, including concerning any inaccuracies or omissions in this website and/or the Company’s literature; and b) excludes all liability for damages arising from or in connection with your use of this website. This includes, without limitation, direct loss, loss of business, travel arrangements or profits (whether or not the loss of such profits was foreseeable, arose in the ordinary course of things, or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential, and incidental damages. c) In any case, our liability is capped to the value of the transaction. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.

5  Payment and Cancellation Policy

All payments must be made online unless we explicitly agree otherwise with you in writing. For security purposes, we do not store any payment details. All card-related information is provided directly to our merchant provider in their secure environment.

Please note that we are unable to process cancellations for Cuban Tourist Visa purchases, whether obtained through us or another source, regardless of intent or whether purchased more than once. Cuban Tourist Visas are non-refundable.

If additional information is required and not provided within 30 days, the application will be cancelled, and no refunds will be issued.

6  Log Files

We use IP addresses to analyse trends, administer the site, track users’ movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, our web servers automatically log standard access information for systems administration, detecting usage patterns, and troubleshooting purposes, including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within VisaCuba on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

7  Copyright Notice

Copyright and other relevant intellectual property rights exist on all text, logos, pictures, videos, or any media relating to VisaCuba services and the full content of this website.

8  Notification of Changes

VisaCuba reserves the right to change these conditions occasionally as it sees fit. Your continued site use will show that you’re accepting any adjustment to these terms. If there are any changes to our privacy policy, we will announce these changes on our site’s home page and other key pages. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on our website 30 days before these changes occur. You are, therefore, advised to re-read this statement regularly. These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website and undertaking a booking or Contract indicates your understanding, acknowledgment, and acceptance of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.
